JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-07-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Buxar (I) Case No. 64 of 2015 registered for the offences punishable under Sections 406, 420, 120B of the Indian Penal Code.
Petitioner happens to be rice miller and it is alleged that he did not supply the rice and embezzled huge government money.
The contention on behalf of the petitioner is that having more or less similar allegation several accused persons in different cases are enjoying the privilege of anticipatory bail and moreover, the State has already filed Certificate Case against the petitioner.
Considering the aforesaid facts and circumstances
Patna High Court Cr.Misc. No.22058 of 2015 (3) dt.06-07-2015 as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that the above named petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar (I) Case No. 64 of 2015, subject to the conditions as laid down under Section 438
(2) of the Cr.P.C.
