Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner is languishing in custody in connection with Keoti P.S. Case No. 121 of 2015 for the offences instituted under Sections 147, 149, 341, 323, 324, 379, 307, 504 and 506 of the Indian Penal Code.
The allegation against the petitioner is of committing assault to the son-in-law of the informant with khanti, causing injury to him.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.05.2016. The charge sheet has
Patna High Court Cr.Misc. No.29999 of 2016 (3) dt.07-09-2016 2/2 been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. It is alleged that the petitioner had given single khanti blow on the head of the victim. In the injury report, the injury is said to be simple in nature, hence, no offence under section 307 of the Indian Penal Code is made out against the petitioner.
On behalf of the state it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Rakesh Kumar Rakesh, learned Judicial Magistrate-1st Class, Darbhanga in connection with Keoti P.S. Case No. 121 of 2015.
