The petitioner seeks bail in Rajauli P.S. Case No. 06/2019, instituted for offence under Section(s) 420, 120(B)/ 34 of the Indian Penal Code read with Sections 30(a) and 41 of the Bihar Prohibition and Excise Act, 2016.

It is alleged in the written report that during vehicle checking, the police intercepted a truck. On search, the police recovered 3546 litres of illicit liquor from the aforesaid truck kept beneath the Chokar bag.

Learned counsel for the petitioner has submitted that there is no recovery of any illicit liquor from possession of this petitioner. Driver and Khalasi of the aforesaid truck were

Patna High Court CR. MISC. No.37957 of 2019(2) dt.21-06-2019 2/2 arrested by the police, who did not disclose name of this petitioner. Name of this petitioner has been taken by co-accused Kundan Kumar stating therein that petitioner used to provide mobile SIM for the purpose of operating illicit liquor business. Petitioner is in custody since 16.03.3019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. Sessions Judge-cum-Special Judge, Excise, Nawada, in connection with Rajauli P.S. Case No. 06/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner.
