JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-03-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Kishanganj Rail P.S. Case No. 06 of 2016, registered under Sections 370 and 374 of the Indian Penal Code and Sections 23 and 26 of the Juvenile Justice Act.

The accusation is that, on 24.03.2016, informant along with other officials of Child Line and Officer-in-Charge of G.R.P. Kishanganj Railway Station, started to raid at the Railway Station. In that course, 12 children were recovered, out of which, two namely, Md. Safique Alam and Md. Safiquel disclosed that they were taken by this petitioner for job of labourers at Delhi. Learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.12254 of 2017 (2) dt.23-03-2017 petitioner has falsely been implicated in this case mere on suspicion. In fact, Md. Safique and Md. Safiquel, who are said to be recovered by the informant, are the relatives of this petitioner. It is further submitted that petitioner has no criminal antecedent and is in custody since 06.02.2017.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Railway Judicial Magistrate, Katihar, in connection with Kishanganj Rail P.S. Case No. 06 of 2016. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
