2. The petitioners are apprehending their arrest in connection with Mansi P.S. Case No. 147 of 2017 for the offence under Sections 341, 323, 504, 506, 386 and 34 of the I.P.C.

3. As per the prosecution story, the informant has alleged that in the previous month, the petitioners took meat from his shop without paying money. When informant asked for money, they started abusing him and took cash of Rs. 500/- from

It is alleged that on 01.07.2017 at about 06:00 P.M. when the informant was going to his sasural with his parents, all the F.I.R. named accused persons surrounded them and demanded cash of Rs. 1,100/- when he refused, all the accused persons started abusing him. Thereafter, petitioner no. 1 namely, Ranveer Yadav assaulted the informant and his father and also took cash of Rs. 5,000/- and a mobile phone.

Learned counsel for the petitioners submits that the petitioners are innocent and they have falsely been implicated in the instant false case due to village politics at the instance of their enemy. Petitioner nos. 1 and 3 are full brothers and the petitioner no. 4 is their cousin brother. Both the parties are covillagers. Learned counsel further submits that during course of investigation, the police granted bail to the petitioners and chargesheet was submitted in bailable offences but subsequently the learned Magistrate differing with the view of I.O., took cognizance against the petitioners under Sections 386 and 534 of the Indian Penal Code.

5. Learned APP opposes the prayer for bail.

6. Keeping in view the aforesaid facts, this Court is inclined to extend them the privilege of anticipatory bail.

7. Let the petitioners be released on bail in the event of arrest or surrender within a period of four weeks from the date of receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Khagaria, in connection with Mansi P.S. Case No. 147 of 2017 subject to the conditions as laid down under Section 438(2) of the Cr.P.C., as also with the following conditions:- (i) One of the bailors should be close relative of the petitioner.

(ii) if the petitioners tamper with the evidence or threatens the witness, in that case, the prosecution will be at liberty to move for cancellation of bail.

(iii) In case, the petitioners repeat offence of similar nature after enlargement on bail, their bail bonds may be cancelled by the learned trial Court.
