JUSTICE VIKASH JAIN ORAL ORDER 01-02-2021 Heard learned counsel for the petitioner and learned APP for the State. Learned counsel for the petitioner has filed an undertaking to remove all the defects pointed out by the Stamp Reporter as and when required. It is accordingly directed that all defects pointed out by the Stamp Reporter be removed within one month hereof.
2. The petitioner is in custody since 16.06.2020 in connection with POCSO Case No. 09 of 2019 arising out of Chenarai P.S. Case No. 17 of 2019 for the alleged offences under Sections 376, 511 and 34 of the Indian Penal Code and Sections 8 and 12 of the Prevention of Children from Sexual Offences Act.

Patna High Court CR. MISC. No.36710 of 2020(2) dt.01-02-2021 2/3 implicated on the accusation of allegedly attempting to outrage the modesty of the informant as well as her accompanying cousin. It is submitted that the petitioner is not named in the FIR, rather his name has transpired on the extra-judicial confessional statement of co-accused Nanhak Paswan @ Nanku Paswan, who also named co-accused Anil Mahto @ Gobra. Both the said co-accused Nanhak Paswan @ Nanku Paswan, and Anil Mahto @ Gobra have been granted bail by this Court in Cr.Misc. No. 35969 of 2019 and Cr.Misc No.34993 of 2019 respectively. The petitioner claims clean antecedents.
4. Learned APP appears and has been heard.
5. Be that as it may and having regard to the period of custody already suffered since 16.06.2020, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Dhriti Jasleen Sharma, learned Additional Sessions Judge-VIth Exclusive Spl. Court, POCSO, Sasaram, Rohtas in connection with POCSO Case No. 09 of 2019 arising out of Chenari P.S. Case No. 17 of 2019, if he is not otherwise required in any other case.
6. Office shall follow-up to ensure that all defects are removed and compliance with the notices of this Court are made
Patna High Court CR. MISC. No.36710 of 2020(2) dt.01-02-2021 3/3 by the petitioner within the stipulated time provided in para 1 hereinabove, failing which the matter shall be brought to the notice of this Court.
