Petitioner seeks bail in a case registered under sections 467, 468, 471, 420, 414, 307, 272, 273, 120B of the Indian Penal Code and section 47(A) of the Excise Act.

In huge quantity country made liquor was recovered from the orchard of one Jay Prakash Kumar @ Bholu and name of the petitioner was disclosed by local people.

Admittedly, neither petitioner was arrested from the spot nor anything was recovered either from his house or from his conscious possession.

No doubt, petitioner carries criminal antecedent of two cases of similar nature but in the present case except suspicion there is nothing against the petitioner. Moreover, having more or less similar allegation, co- accused Munilal Kumar @ Munilal Sah has already

Patna High Court Cr.Misc. No.34994 of 2016 (2) dt.23-08-2016 been granted the privilege of anticipatory bail by a coordinate bench of this court.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate VI, West Champaran at Bettiah in Nautan (Jagdishpur) P.S. Case no. 64/2016.
