The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 302/34 of the Indian Penal Code.
It is a case of commission of the murder of the brother of the informant.
Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that the main allegation of assault to the deceased is against co-accused Jago Singh and the said co-accused Jago Singh was getting the privilege of regular bail by a Co-ordinate Bench of this Court passed in Cr. Misc. No. 8685 of 2022. He
Patna High Court CR. MISC. No.39982 of 2022(2) dt.31-08-2022 2/2 further submits that the petitioner was only present at the time of occurrence and the viscera of the deceased was preserved. Petitioner has clean antecedent.
However, learned APP for the State opposed the prayer for anticipatory bail of the petitioner. Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Darbhanga in connection with Bishanpur P.S. Case No. 31 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
