JUSTICE SANJAY PRIYA ORAL ORDER 28-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks bail in Tariyani P.S. Case No. 35 of 2016 instituted for the offence under Sections 363 and 364(A) of the Indian Penal Code.

It is alleged that father of the informant has gone to North Bihar Gramin Bank, Brindaban Branch but did not return. The statement of the father of the informant was recorded under Section 164 Cr.P.C. in which he has not named this petitioner.

It has been submitted that other co-accused with similar allegation has already been granted bail by a co-ordinate Bench of this Court vide order dated 02.08.2016 passed in Cr.

Patna High Court Cr.Misc. No.19031 of 2017 (2) dt.28-04-2017 2/2 Misc. No. 23291/2016. The name of this petitioner has been disclosed by the aforesaid accused, Mukesh Kumar Singh @ Mukesh Singh in his confessional statement.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sheohar in connection with Tariyani P.S. Case No. 35 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
