The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 304(B) and 201/34 of the Indian Penal Code.

It is alleged that the petitioner along with other family killed informant's daughter due to non-fulfilment of dowry demand and they secretly disposed of the dead body. It is submitted on behalf of the petitioner that the petitioner who happens to be the mother-in-law of the deceased has been falsely implicated in this case as the main allegation is against her husband who is already in custody. Further, informant's daughter died due to cold attack and no occurrence

Patna High Court CR. MISC. No.38395 of 2019(3) dt.14-08-2019 2/2 took place as alleged in the FIR. It is also submitted that there is no specific allegation against her. Petitioner has got no criminal antecedent.

Considering the facts aforesaid, let the petitioner above named, in the event of her arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada/successor Court in connection with Warisaliganj P.S.Case No.07 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioner.
