The petitioner seeks bail in a case for the offences punishable under Sections 302, 201/34 of the Indian Penal Code. Allegedly the son of the informant was found dead and suspicion was raised against Anandi Das, in whose band party the deceased was working as dancer. During investigation in the confessional statement of co-accused Pushpa Devi, the name of the petitioner transpired.
Submission is of false implication and that there is no legal and tangible material against the petitioner beside the confessional statement. No eye witness has come forward to state the name of the petitioner, Pushpa Devi, who has already been
Patna High Court Cr.Misc. No.17086 of 2017 (2) dt.05-05-2017 2/2 allowed bail by a co-ordinate bench of this court in Criminal Miscellaneous No. 7960 of 2017, and as such the petitioner also deserves the sympathetic consideration.
Learned A.P.P for the State submits that the name of the petitioner has transpired in the confessional statement of coaccused Pushpa Devi. In the facts and circumstances as stated above, the petitioner is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. Araria in connection with Narpatganj (Bathnaha) P.S. Case No. 388 of 2016 (G.R. No. 3863 of 2016).
