JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 414 of the Indian Penal Code. The police got information that three to four persons came on motorcycle at Bamboo clump of Md. Ibrahim and they were making plan to commit crime. Having got the aforesaid information police reached there and arrested the petitioner with one motorcycle whereas the associate of the petitioner managed to escape from there leaving behind a motorcycle on the place of occurrence. The police seized the second motorcycle also. Petitioner disclosed before the informant that both the aforesaid

Patna High Court Cr.Misc. No.30068 of 2016 (3) dt.04-10-2016 2/2 motorcycles belonged to one Md. Sawood, who had asked the petitioner to sell the said motorcycles. Petitioner does not have any criminal antecedent and is languishing in jail custody since 20.04.2016. The investigation against the petitioner has already been completed.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Araria in connection with Jokihat P.S. Case No. 99 of 2016.
