JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 302/201/120(B)/34 of the Indian Penal Code. Petitioner is not named in the first information report but when further statement of informant was recorded, she disclosed the name of the petitioner in connection with the present case. In course of investigation, some witnesses claimed to have seen the petitioner in the company of the deceased. The investigation against the petitioner has already been completed and, therefore, even if the material came in this case assumed to be true, then also, it is only a case of last seen.

Patna High Court Cr.Misc. No.28246 of 2016 (3) dt.27-09-2016 2/2 Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II, Siwan in S.Tr. No.124 of 2016 arising out of Raghunathpur P.S. Case No.193 of 2015.
