2. Learned counsel for the petitioners has submitted that petitioner nos. 2 and 5 have already been granted bail by the trial Court itself, as such, he is pressing the bail application of remaining petitioners i.e. petitioner nos. 1, 3, 4 and 6.

3. The petitioners have prayed for bail in connection with Bheldi P.S. Case No. 341 of 2024 registered for the offence

Patna High Court CR. MISC. No.38963 of 2025(4) dt.03-09-2025 2/3 punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 118(1), 103(1), 303(2), 352, 351(2) of B.N.S. and Section 27 of the Arms Act.

4. The case of the prosecution is that the petitioners along with others started ploughing the land of the informant. On this, one Chhote Lal, Harendra Singh, Ranjit Kumar and Amresh Kumar went there and objected. It is further alleged that Bachha Singh ordered to crush Chhote Lal with the help of tractor. It is further alleged that he was dashed with tractor due to which he fell down and after that Bachha Singh assaulted badly with lathi due to which he died. It is further alleged that ladies of the family assaulted the other members.

5. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. They have been falsely implicated in this case. From perusal of the F.I.R. itself it is clear that that specific allegation is against Bachha Singh but he is not the petitioner. The allegation against the petitioners is general and omnibus. Petitioners are having no criminal antecedent and they are in judicial custody for more than five months.

6. The application for bail is opposed by learned APP for the State and learned counsel for the informant. Learned counsel for the informant has submitted that if the petitioners will

7. Having heard learned counsel for the parties and considering the fact that as charge sheet has already been filed, the chances of tampering evidence are least, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned concern Court, Saran, Chapra in connection with Bheldi P.S. Case No.341 of 2024.
