The defect(s) as pointed by the office in Criminal Miscellaneous No. 15187 of 2017 be ignored.

Both the aforesaid applications arise out of Nawada Town P.S. Case No. 728 of 2016, registered under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016. Therefore, both the aforesaid applications have been heard together and are being disposed of by this common order.

No.14192 of 2017 (2) dt.07-04-2017 2/2 The accusation is that in course of checking of the vehicle one bolero vehicle was searched in which 1800 pouches, each containing 200 ML illicit country made liquor was recovered. The aforesaid bolero vehicle was being driven by the petitioner Pintu Kumar and petitioner Pankaj Kumar was found sitting in that vehicle.

Learned counsel for the petitioners submits that petitioners are in custody since 27.12.2016, while petitioner Pintu Kumar is accused in Hisua P.S. Case No. 158 of 2016, but he is on bail in that case.

Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada in connection with Nawada Town P.S. Case No. 728 of 2016. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
