JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Ram Krishna Nagar P.S. Case No. 103 of 2019 registered for the offences punishable under Sections 420 and 406 of the Indian Penal Code.

As per FIR some articles which were carried by Tata Ace Van bearing Registration No. BR 01GC 3597 of which petitioner happens to be driver, were found missing at the time of delivery.

Submission of learned counsel for the petitioner is that FIR itself shows that the person of the informant was also travelling along with the driver in the same van, as such petitioner has falsely been implicated only on suspicion and he is ready to abide by any condition that may be imposed on him

Patna High Court CR. MISC. No.38541 of 2019(5) dt.15-11-2019 2/2 and he has no criminal antecedent.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Sub-Judge-XIII-cum- ACJM, Patna, in connection with Ram Krishna Nagar P.S. Case No. 103 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition that petitioner has to co-operate in the investigation and appear before the police as and when required.
