Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 342, 323, 504, 506, 354, 354(B), 420, 420, 406, 34 of the Indian Penal Code.
The prosecution case is that the husband of the informant deposited Rs. 25,000/- in the account of petitioner No. 1 for giving it to the informant but when the informant demanded the money, she was being abused, assaulted and her thumb impression was taken on the plain paper.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.22376 of 2015 (2) dt.07-07-2015 2/2 petitioners that informant filed Complaint Case No. 240C of 2015 for the same cause of action on 21.03.2015 and thereafter the present case was lodged on 01.04.2015. The petitioner No. 1 filed Bhaptiyahi P.S. Case No. 07 of 2015 against the fatherin-law of the informant levelling accusation under Sections 323, 353, 379, 406, 420, 504, 506/34 of the Indian Penal Code on 20.01.2015. Hence, as a retaliatory measure the present case has been lodged.
A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the case lodged by the petitioners at earlier point of time, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Supaul Mahila P.S. Case No. 23 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
