JUSTICE SUDHIR SINGH ORAL ORDER 03-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 342, 386, 379 and 34 of the Indian Penal Code.

The allegation against the petitioner is that he along with others wrongfully confined the informant and made a demand of Rs. 1 lac in order to permit him to purchase the land in his area. On protest being made, he was tried to be dragged towards the hill area giving threatening to kill him. The petitioner and other accused persons also snatched Rs. 5,000/- from his pocket. It has been submitted on behalf of the petitioner that the petitioner has no criminal antecedent. Further, it is submitted that due to land dispute between the petitioner and the

No.23239 of 2015 (3) dt.03-09-2015 2/2 Mukhia of the concerned Panchayat the present case has been instituted as the petitioner had made a number of complain against Mukhia to the District Magistrate, Gaya, photo copy of the said petition is enclosed to the present application. There is no specific allegation made against the petitioner.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Kumari Vijaya, learned J.M., 1st Class, Gaya, District- Gaya in connection with Neemchak Bathani P.S.Case No. 72 of 2013, subject to the conditions as laid down u/s 438(2) Cr.P.C.
