The petitioner who is in custody since 13.03.2018 seeks bail in connection with Trial No. 2141 of 2018 arising out of Dhaka P.S. Case No. 44 of 2016 dated 26.02.2016 instituted for the offences under Sections 147, 148, 149, 447, 506, 323, 325 and 307 of the Indian Penal Code.
The petitioner as well as the other accused persons are said to have come to the house of the informant and indulged in assault. The petitioner is alleged to have inflicted dabiya blow on the son of the informant viz. Rashid leading to injuries.
Learned counsel for the petitioner has submitted that the injuries suffered by Rashid are simple
Patna High Court Cr.Misc. No.25786 of 2018(3) dt.18-05-2018 2/2 in nature. It has further been submitted that despite there being allegation in the FIR against the petitioner, the police did not find the allegation to be true and therefore did not send him up for trial. However the learned Sub-Divisional Judicial Magistrate differing with the police report took cognizance against the petitioner as well.
For the aforestated facts, the petitioner above named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sikrahana at Dhaka, East Champaran in connection with Trial No. 2141 of 2018, arising out of Dhaka P.S. Case No. 44 of 2016.
