JUSTICE SUDHIR SINGH ORAL ORDER 16-04-2015 The petitioner is apprehending his arrest in connection with Ujiarpur P.S.Case No. 101 of 2014 registered under Section 376/511 of the Indian Penal Code.
Heard learned counsel for the petitioner and the State. It has been alleged that when the informant, Kanchan Devi, who was returning on the way, reached in front of Kabir Math, this petitioner, who is disciple of Mahanth Vishnu Das caught hold of her hand and forcibly dragged her inside the Math and thereafter it is alleged that he attempted to commit rape on her. On her cry, her mother-in-law reached there and removed Govind Das by pushing him.
It has been submitted on behalf of the petitioner that prior to institution of the present case, a case was instituted by the petitioner in which the informant is an accused and the petitioner
Patna High Court Cr.Misc. No.45531 of 2014 (3) dt.16-04-2015 2/2 had sustained injury. In support of his contention the petitioner has referred to Annexure- 3, which is injury report of the petitioner. It is further contended on behalf of the petitioner that the informant of the present case, due to land dispute, to save herself got a counter case instituted with an intention to falsely implicate him. On behalf of the State it has been vehemently opposed. Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Dalsingsarai in the district of Samastipur in connection with Ujiarpur P.S. Case No. 101 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
