Heard learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 409, 420 of the Indian Penal Code.

Prosecution case as lodged by the informant is that the petitioner who was the then Panchayat Sachiv of Gram Panchayat Raj Ramnagar Bedaul in collusion with the then Mukhia illegally withdraw Rs. 7,83,000/- for construction of community hall and PCC road under BRGF scheme no. 1/12-13 in Gram Panchayat Raj Ram Nagar Bedoul and misappropriated the said amount by committing forgery.

Patna High Court CR. MISC. No.35850 of 2019(3) dt.14-08-2019 2/2 I have gone through the record, it transpires that the construction work of community hall has been completed. The petitioner has deposited Rs. 4,00,000/- in the Nazarat of Pupari block and copy of challan has also been filed. In the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Pupri at Sitamarhi in connection with Pupri Police Station Case No. 374 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
