JUSTICE SATYAVRAT VERMA ORAL ORDER 27-01-2022 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in connection with Purnahiya P. S. Case No.95 of 2021, instituted for the offences under Sections 25(1-B)a, 26, 35 of the Arms Act and Section 399, 402 of the I.P.C.

The learned counsel for the petitioner submits that the petitioner is in custody since 09.06.2021, charge-sheet has been submitted in the case and petitioner has antecedent of one case as mentioned in Para-3 of the petition. Allegation is of recovery of one country-made pistol, four live cartridges and one country-made pistol with

The learned counsel for the petitioner submits that mobile and the motorcycle belongs to the petitioner and his father. As far as allegation of recovery is concerned, the petitioner has been falsely implicated as nothing was recovered from his possession. Learned counsel submits that the petitioner has remained in custody for nearly seven months and charges have been framed. As such, there is no question of tampering with the evidence.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody since 09.06.2021, charges have been framed and is a young boy of 19 years, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Sheohar in connection with Purnahiya P. S. Case No.95 of 2021, subject to condition that one of the bailors shall be the father of the petitioner namely, Ram
