JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 10-01-2023 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner has prayed for bail in a case registered for the offence punishable under sections 341, 323, 324, 307 and 447 of the Indian Penal Code.

As per allegation in the FIR, in a Barat Party petitioner along with other accused persons were assaulting to the son of the informant, which was seen by the informant and when she raised alarm, they fled away from there leaving behind her senseless son.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has been falsely implicated in this case. It reveals from injury report that there is no significant abnormality detected. Petitioner is in custody since

The application for bail is opposed by learned APP for the State and learned counsel for the informant. Learned counsel for the informant has submitted that informant's son has sustained stabbed injury which is grievous in nature. Having heard learned counsel for the parties and considering the period of custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate I Class, Chapra, Saran in connection with Rasulpur P.S. Case No. 105 of 2022.
