JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 07-12-2022 Heard learned counsel for the petitioners, learned counsel for the informant and learned APP for the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 307, 504, 506/34 of the Indian Penal Code and Sections 25(1-B)(a)/27/35 of Arms Act.

It is a case of opening fire by the petitioners and co-accused persons. Specific allegation against petitioners is that they fired upon the family members of the informant to which they narrowly escaped.

It is submitted by learned counsel for the

Patna High Court CR. MISC. No.40675 of 2022(2) dt.07-12-2022 2/2 petitioners that petitioners are quite innocent and they have falsely been implicated in the present case. There is case and counter case between the parties.

In the facts and circumstance of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Danapur, Patna in connection with Shahpur P.S. Case No. 460 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
