The petitioner apprehends his arrest in a case registered for the offence under Sections 406, 420, 467 of the Indian Penal Code.

As per F.I.R., this petitioner, in collusion with other accused persons, got executed gift deed in favour of the petitioner from his father Bashisth Narayan Thakur (since dead) in order to create illegal right over the land in question. It is submitted on behalf of petitioner that dispute is civil in nature. Informant is own brother of the petitioner and due to petty family dispute between the parties, a false and concocted case has been lodged against this petitioner. It is further submitted that no criminal offence is made out and it is out-and-out a civil dispute. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.39818 of 2022(2) dt.28-11-2022 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Sitamarhi in connection with Parihar P.S.
