JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 387, 435, 427/34 of the Indian Penal Code and Section 17 of C.L.A. Act.

The name of petitioner is said to be disclosed by the villagers and after that petitioner was arrested and remanded in the present case on 28.04.2016. Petitioner does have criminal antecedent of some cases but in the present case, except the above stated material, there is nothing against him. Moreover, having more or less similar allegation, some co-accused have already been granted privilege of bail.

Considering the aforesaid facts and circumstances as

No.30168 of 2016 (2) dt.04-08-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Gaya at Sherghati in connection with Sherghati P.S.
