The petitioner is seeking anticipatory bail in connection with Muzaffarpur Rail P.S. Case No. 150 of 2019 instituted for the offences under Sections 387 and 506 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the allegation against him is that he called the informant from his mobile bearing number 8877748794 on the mobile of informant and disclosed his name as Gopal Thakur and thereafter gave the phone to Raushan Mishra who demanded extortion amount of Rs. 2.50 lakhs threatening that in the event if the money is not

Learned counsel for the petitioner submits that no prudent man would indulge in such act wherein from his own mobile phone will give threatening call to the informant and will get implicated in the case.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the fact that the petitioner is a person with clean antecedent and that no prudent person would indulge in such an act using his own mobile phone for giving threatening call, the Court thinks it fit to grant privilege of anticipatory bail to the petitioner, let the petitioner abovenamed, in the event of his arrest or surrender before the learned Court below within a period of ten weeks, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Railway Sonpur, Saran in connection with Muzaffarpur Rail P.S. Case No. 150 of 2019 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
