The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 363, 366A and 34 of the Indian Penal Code.

The informant alleges that her minor daughter went to Maneshwar Asthan Mandir but did not return till evening, accordingly a search was made when informant came to know that her daughter was kidnapped by accused persons, including this petitioner, from the temple itself.

Learned counsel for the petitioner submits that the petitioner is a woman having clean antecedent and has been falsely implicated in the present case and from perusal of the allegations as alleged in the F.I.R. it would manifest that the date of occurrence is 07.12.2021 and the F.I.R. was instituted on

Patna High Court CR. MISC. No.39923 of 2022(2) dt.12-09-2022 2/2 04.01.2022 i.e., after a delay of nearly 27 days. Petitioner is sister of Krishna Kumar who is alleged to be the main accused, further it is next submitted that the victim has returned and her statement under Section 164 Cr.P.C. was recorded wherein she has not supported the prosecution case. It is next submitted that it is a case of elopement where the family members of Krishna Kumar, including his sister, came to be implicated. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Sursand P.S. Case No. 08 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
