JUSTICE BIRENDRA KUMAR ORAL ORDER 11-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offence punishable under Section 304 of the Indian Penal Code. During occurrence of assault the petitioner allegedly caused injury with brickbat at the head of the grandfather of the informant as a result whereof he died subsequently. The petitioner has also sustained injury at the time of occurrence. Submission of the petitioner is that when the petitioner was being assaulted by Ramjee Mato and others, in her self-defence she threw brick which might have hurt the deceased. Considering the nature of allegation and the fact that petitioner is a female, let petitioner, above named, be enlarged

Case No.206 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
