JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 15-02-2023 Heard learned counsel for the petitioners, learned counsel for the informant and learned APP for the State. The petitioner has prayed for bail in a case instituted for the offence under Sections 341, 385, 504, 323, 324, 325, 307, 354, 379, 427, 506/34 of the Indian Penal Code. As per allegation in the FIR, while the informant was at his clinic, petitioner no. 1 came there and demanded extortion of Ts. 10,000 and assaulted him with farsa on his head and petitioner no. 2 assaulted him by means of dabiya as a result of which informant sustained head injury and bleeding. When his staff Manish Kumar came there to save him, he was also beaten up by the accused persons. It is further alleged that accused persons took Rs. 20,000/- from his clinic counter and ornaments

It is submitted by learned counsel for the petitioners that petitioners have been falsely implicated in this case. They have committed no offence. Petitioners have no criminal antecedents. Informant has sustained three injuries out of which two are simple in nature and one injury is grievous in nature but the same on elbow which is non-vital organ. Petitioners are languishing in judicial custody since 4.3.2022. The application for bail is opposed by learned APP for the State and learned counsel for the informant. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned ACJM 1st, Madhubani in connection with Rajnagar P.S. Case No. 29 of 2022.
