JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 379, 411, 34 of the Indian Penal Code.

The accusation against the petitioner is that he along with one other accused took out the mobile of the informant but according to prosecution case itself, the aforesaid mobile was recovered beneath the seat of a tempo though it is said that the aforesaid recovery was made on the basis of disclosure of the petitioner. Petitioner does not have any criminal antecedent and is languishing in jail custody since 13.04.2016.

Patna High Court Cr.Misc. No.37060 of 2016 (2) dt.06-09-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Kotwali P.S. Case No. 158 of 2016.
