Petitioner is apprehending his arrest in connection with Kanti P.S.Case No.06/2019 , registered for offences punishable under Sections 341, 323, 379, 498(A)/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. Allegation against the petitioner is of demand of Rs.02 lac and for non-fulfillment of the same, assaulted her. Submission of the learned counsel for the petitioner is that allegations are false and concocted. It is his consistent stand even before the learned court below that he is ready to keep her and the learned court below has also asked the petitioner to persuade her for residing with him by going to her Maike but she appeared and refused to reside with the
Patna High Court CR. MISC. No.36067 of 2019(3) dt.16-09-2019 2/2 petitioner making some allegations and also stating that she apprehends danger.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM (West), Muzaffarpur in connection with Kanti P.S.Case No.06 of 2019 subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition that if the complainant is ready to reside with the petitioner, he has to keep her with dignity and care.
