JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 18-05-2015 In the present application filed under section 482 of the Code of Criminal Procedure, the petitioner has challenged the first information report in connection with Hajipur Town P.S. Case No.240 of 2015.
Learned counsel for the petitioner has submitted that the informant has launched an out and out a frivolous and malicious prosecution against the petitioner. There is nothing on record on the basis of which it can be said that the informant has paid any amount to the petitioner.
Since the matter is under investigation, it would not be proper for this Court to give any finding regarding bona fide of the allegation. At this stage, learned senior counsel for the petitioner
Patna High Court Cr.Misc. No.22875 of 2015 (2) dt.18-05-2015 2/2 seeks leave to withdraw this application in order to raise all his points if after completion of investigation the police submit an adverse report against the petitioner.
