The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 363 and 366A/34 of the Indian Penal Code. It is alleged that the petitioners being the tenants of the informant kidnapped the minor sister of the informant.
It is submitted by learned counsel for the petitioners that in 164 Cr.P.C. statement the stated that petitioner no. 1 asked the victim to go to Market and from there accused persons took her to Mohania and kept for three days and
Patna High Court Cr.Misc. No.46545 of 2014 (02) dt.24-04-2015 2/2 thereafter they reached her to Mohania. It is further stated that there is nothing on record to show that the victim was actually confined. For the purposes of lodging this case the accusation has been levelled in the background of tenancy dispute. In 164 Cr.P.c. the victim has stated that none misbehaved with her. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Bhabua P.S. Case No. 341 of 2014 pending in the court of learned Chief Judicial Magistrate, Kaimur at Bhabua.
With the aforesaid observation, this application is disposed of.
