This application is for grant of regular bail in connection with Sohsarai P.S.Case No.133 of 2016, for the offences under Sections 304(B)/34 of the Indian Penal Code. The petitioner is husband and allegation is about dowry death, however, it is submitted on behalf of the petitioner that he is mentally unsound and in support it, a medical certificate has also been annexed with this petition.
Heard learned A.P.P. and the learned counsel for the informant. They have opposed the prayer for bail stating that he is mentally sound and the medical certificate has been brought later on.
Having heard both sides and considering submissions, this

No.19511 of 2017 (3) dt.19-05-2017 2/2 application is disposed of with direction that the learned trial court shall examine the matter of bail and start trial in accordance with provisions as contained in Chapter - XXV of Cr.P.C. dealing with the provisions regarding accused persons of unsound mind and to pass appropriate order.
