JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-08-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are parents in law of the deceased and are languishing in jail custody since 15.04.2016 in a case registered for the offences punishable under Sections 304(B), 201, 34 of the Indian Penal Code.
Submission on behalf of the petitioners is that according to prosecution case itself, the marriage of deceased had taken place four years ago and she spent her married life happily and peacefully for near about three years at her matrimonial home and after that so-called demand of dowry was made. It is further submitted that as a matter of fact, deceased died of her natural

No.30836 of 2016 (2) dt.09-08-2016 2/2 death and information regarding her death was given to informant and others but informant lodged this case against the petitioners at the behest of their enemies. Moreover, the investigation, against the petitioners appears to have already been completed. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Salkhua P.S. Case No. 62 of 2016.
