JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 399, 402, 411, 412, 413, 414 of the Indian Penal Code and 25(1-b)a, 26 and 35 of the Arms Act.

Some co-accused were apprehended by the police when they had assembled to make preparation for committing dacoity. The aforesaid apprehended accused disclosed that they used to keep the looted articles in the house of the petitioner. Subsequently, the house of the petitioner was searched and one mobile set, two pairs of silver Payal and cash of Rs.29,500/- were recovered from her house.

The learned court below has rejected the prayer for

Patna High Court Cr.Misc. No.31591 of 2016 (2) dt.17-08-2016 2/2 bail of the petitioner taking note of this fact that petitioner happens to be foreign citizen but the present case has not been lodged under Foreigner Act and, therefore, considering the facts and circumstances of the case as well as taking note of this fact that petitioner does not have any criminal antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 5th Additional Sessions Judge, Siwan in connection with Siwan Town (Sarai) P.S. Case No.30 of 2016, subject to the condition that one of the sureties must be local and holder of the landed property.
