JUSTICE SUDHIR SINGH ORAL ORDER 02-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 379 and other allied Sections of the Indian Penal Code.

The prosecution story, in brief, is that on 14.11.2014 at abut 5 P.M. the informant met with the petitioner and demanded Rs. 50,000/- of Sugarcane, on which the petitioner called at his home and when the informant reached at the house of the petitioner , the petitioner abused him by calling his caste name and spitted on his face and also assaulted him by iron rod, as a result of which the informant received injury on his leg. Co-accused Ram Lal Sahani also assaulted him by Gadasi and Laddu Sahani snatched his golden chain and wrist watch.

There is a case and counter case. It is further submitted that the alleged occurrence is said to have taken place inside the house, hence no offence under SC/ST is attracted in the present case.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, let above named petitioner, in the event of his arrest/surrender in the court below within a period of four weeks from today be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Motihari, East Champaran, in Piprakothi P.S.case No. 166/2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
