2. In the present case, the petitioner seeks bail in connection with Rajpur P.S. Case No. 372 of 2024 registered on 11.12.2024 for the offences under Sections 126(2), 127(2), 115(2), 118(1), 109, 352 and 3(5) of the BNS.
3. As per prosecution case, husband of the informant was assaulted by the petitioner and other co-accused person with lathi and rama and allegation against this petitioner is that he gave rama blow on the head of the husband of the informant causing its fracture. Husband of the informant became unconscious and assailants left him taking him to be dead.
4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been
Patna High Court CR. MISC. No.41699 of 2025(4) dt.15-09-2025 2/3 falsely implicated in this case. FIR has been lodged after delay of 24 days and there is no explanation for the said delay. From the FIR, it is also evident that the informant is not an eyewitness and she lodged the FIR after much delay and her statement is not believable. Petitioner is in custody since 12.12.2024 and charge-sheet has been submitted. Petitioner is having antecedent of two cases in which he is on bail.
5. Learned A.P.P. opposes the submission made on behalf of the petitioner.
6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner and submission of chargesheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-X, Buxar/concerned court in connection with Rajpur P.S. Case No. 372 of 2024, subject to the conditions mentioned in Section 480(3) of the B.N.S.S. and other following conditions:
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
