The petitioner is apprehending his arrest in connection with Kumar Khand P.S. Case No. 173 of 2010 registered for the offences punishable under Sections 467, 468, 471, 420, 413, 414, 120(B) of the Indian Penal Code.

Learned counsel for the petitioner submits that only allegation which has been levelled against the petitioner is that while he was posted as in-charge DTO, the petitioner had placed his signature on the registration of a vehicle which is alleged to have been stolen from Noida. Learned counsel for the petitioner further submits that there is a prescribed procedure for giving fresh registration number and it is not expected from a DTO to

Patna High Court Cr.Misc. No.30765 of 2015 (2) dt.11-08-2015 2/2 investigate about the sale from the seller if it is authorized by a DTO of another district.

Considering the nature of allegation and also the fact neither the petitioner is named in the FIR nor there is any evidence against him, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Madhepura in connection with Kumar Khand P.S. Case No. 173 of 2010, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
