The State is represented by Mr. Ram Priya Sharan Singh, learned APP.

The petitioner seeks bail in connection with Magadh Medical P.S. Case No. 250 of 2019, dated 29.10.2019, instituted for the offences under Sections 302

Patna High Court CR. MISC. No.36512 of 2020(3) dt.12-03-2021 2/3 and 34 of the Indian Penal Code and Section 7 of the Arms Act.

The allegation against the petitioner is of firing at the deceased in order to scare him away from an orchestra programme, which had been organized by him.

This does not appear to be a case of celebratory firing.

In view of the accusation in the F.I.R., I am not inclined to grant bail to the petitioner for the present. The prayer for grant of bail of the petitioner is, accordingly, rejected.

However, taking into account the fact that the petitioner is in custody since 24.01.2020, this Court directs that the trial of the petitioner be expedited and concluded positively within a period of one year from the date of receipt/production of a copy of this order, failing which, the petitioner would have the liberty to approach the Trial Court for grant of bail and in that event, the Trial Court would be required to state the reasons for non-conclusion of the trial within the aforesaid period.
