The petitioner seeks bail in a case instituted for the offences punishable under Section 379 and 411 of the Indian Penal Code.

Petitioner is not named in the First Information Report, but it is submitted on behalf of the petitioner that petitioner was arrested in connection with Gandhi Maidan P.S. Case No. 78 of 2016 and under coercion police got recorded the confessional statement of petitioner in the present case also and on that basis police remanded the petitioner in the present case. The impugned order of learned Additional Sessions Judge does not disclose as to how the name of petitioner has come in this case and the learned Additional Sessions Judge has only

No.31481 of 2016 (2) dt.12-08-2016 2/2 mentioned in the impugned order that sufficient materials have come against the petitioner in course of investigation, but he failed to mention what material has come against the petitioner. However, considering the aforesaid facts and circumstances as well as submissions made on behalf of the parties, let petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna in connection with Gandhi Maidan P.S. Case No. 73 of 2016.
