The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,341,323,324,307,379 and 506 of the Indian Penal Code.
It is alleged that the accused persons came to the informant variously armed. On the order of co accused Ram Kumar Singh, co accused Roushan Singh with iron rod, petitioner Rajendra Singh with lathi and Baburam Singh with iron rod assaulted the informant when the uncle of the informant Narayan Singh came to rescue then he
Patna High Court Cr.Misc. No.23361 of 2015 (2) dt.25-06-2015 2/3 was assaulted by petitioner no.1 with Garasa and thereafter he was assaulted by Ranvijay Singh, Raghubansh Singh and others.
It is submitted by the learned counsel for the petitioners that the injuries of the informant have been found to be simple whereas the opinion with regard to the injury of informant's uncle has been kept reserved. Though the petitioners are alleged to have caused injury with sharp cutting weapon but the doctor has opined that the injury has been caused by hard and blunt substance. There is counter version of the occurrence and the petitioners side also received injury. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad in connection with Amba P.S. Case No. 40 of 2014 subject to the conditions as laid down under
