1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner apprehends his arrest in connection with Korha P.S. Case no.121 of 2024 registered under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code read with Section 10 of the Bihar Conduct of Examination Act, 1981.
3. As per the prosecution case, upon Bio-metric Test report, credentials of the seven candidates were found to be fake, as the verification data of these candidates did not match with the actual candidates and consequently, these seven candidates were named in the F.I.R.
4. Learned counsel for the petitioner submits that the petitioner is a student preparing for competitive exam and as a matter of fact, he had appeared in the said examination and there was no case of impersonation. Learned counsel for the petitioner has drawn the attention of this Court to the Annexure-2 of the
Patna High Court CR. MISC. No.38255 of 2025(2) dt.27-06-2025 2/3 petition that similarly situated co-accused persons who are the actual candidates, had been granted anticipatory bail by the learned Court below vide order dated 20.06.2024 in A.B.P No. 618 of 2024. It has been recorded in the said order that the persons who were actually caught impersonating have also been granted regular bail by the learned Court below. Further another similarly situated co-accused Ramesh Kumar has also been granted anticipatory bail vide order dated 23.04.2025 passed in Cr. Misc. No. 84838 of 2024. The petitioner has no criminal antecedent and undertakes to cooperate in the investigation/trial.
5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

Taking into consideration the facts of the case and also considering the fact that the petitioner is a young student aged about 23 years being the actual candidate, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Kodha P.S. Case no.121 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/Successor Court, subject to the
Patna High Court CR. MISC. No.38255 of 2025(2) dt.27-06-2025 3/3 condition laid down under Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the B.N.S.S, 2023 and subject to the further condition that one of the bailors of the petitioner shall be the family member/close relative of the petitioner.
