2. The petitioner is in custody since 28.06.2016 in connection with S.C./S.T. P.S. Case No. 54 of 2013 for the offences alleged under Sections 323, 341, 379, 504, 448/34 of the Indian Penal Code and 3(i)(x) of the Scheduled Castes/Scheduled Tribes (Prevention of Atrocities) Act.
3. It is submitted that the petitioner has been falsely implicated in connection with an admitted land dispute between the parties. It is further submitted that the ingredients of offence under Scheduled Castes/Scheduled Tribes Act are not made out as the alleged occurrence was not transpired in public view.
4. Having regard to the entirety of the facts and circumstances of the case, let the petitioner above named be
Patna High Court Cr.Misc. No.32910 of 2016 (2) dt.22-08-2016 2/2 released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Ara, in connection with S.C./S.T. P.S. Case No. 54 of 2013.
