JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-04-2017 The petitioner seeks regular bail in connection with Silao P.S. Case No. 151/16, registered for offences punishable under Section 25(1-b) a/26 Arms Act and Section 37 (B)/37(C) of Bihar Excise Amendment Act, 2016.

Allegation is that the police on information caught the petitioner with a country made pistol and also in drunken condition.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case due to enmity with seizure list witnesses. Petitioner lives in Kerala for earning his livelihood and has come on leave. Petitioner has no criminal antecedent and has been in judicial custody since 23.12.2016. Heard learned A.P.P. also.

No.16112 of 2017 (3) dt.21-04-2017 2/2 Having heard both sides, considering the facts and circumstances of the case and the nature of allegation, I am not inclined to grant the petitioner, the privilege of regular bail, at least, at this stage. His prayer for bail is, accordingly, rejected. However, petitioner may renew his prayer for bail before the court below itself after framing of charge in this case. (Vinod Kumar Sinha, J) sunil/- U T
