The present criminal miscellaneous application has been filed under Sections 483 and 484 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of regular bail to the petitioner who is in custody in connection with Bela P.S. Case No. 08 of 2026, lodged on 10.01.2026, under Sections 103(1)/3(5) of the Bhartiya Nyay Sanhita, 2023, pending in the Court of S.D.J.M., Sitamarhi.

3. As per the prosecution, FIR has been lodged against five named accused persons including the present petitioner. Specific allegation of taking away the son of the informant is against Vijay Mahto, Raghuvir and Raghuvir Kumar. On the next day, she learnt that her son Avinas Kumar was shot dead

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that petitioner is in custody since 12.01.2026 having clean antecedent. He submits that petitioner has falsely been implicated and he has no concerned with the alleged occurrence. He submits that from the FIR it transpires that the alleged victim was taken away on a motorcycle by Vijay Mahto and Raghuvir. The allegation against him is that he was following them on another motorcycle, which is completely false and fabricated. Counsel further submits that petitioner is ready to fulfill all the conditions whatsoever shall be imposed upon him.

Learned Counsel for the informant as well as State vehemently oppose the prayer for bail of the petitioner and submits that the petitioner was last seen going with the deceased along with his uncle, who is father-in-law of the petitioner, and on the next day his dead body was found lying near Dhunia Toll Math having gun shot injury.

6. In this background, this Court is not inclined to grant bail to the petitioner at present. Hence, the prayer for bail of the petitioner is hereby refused.
