JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 399, 402 of the Indian Penal Code and Section 25(1-b)a, 26, 35 of the Arms Act.

One country made pistol is said to have been recovered from conscious possession of the petitioner when petitioner and others allegedly had assembled to make preparation for committing dacoity.

No doubt, rifle etc. were recovered from the Tempo in which petitioner and his associates were found sitting but taking note of the above stated fact as well as this aspect of the matter that except the present case as well as one case, i.e., Aurai P.S.

Patna High Court Cr.Misc. No.36297 of 2016 (2) dt.23-08-2016 2/2 Case No.40 of 2015 and Rajepur P.S. Case No.71 of 2016, petitioner does not have any criminal antecedent and is languishing in jail custody since 8.1.2016, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 3rd Additional Sessions Judge, Muzaffarpur in connection with Sessions Trial No.346 of 2016 arising out of Bochahan P.S. Case No.2 of 2016.
