JUSTICE SUDHIR SINGH ORAL ORDER 16-04-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in connection with Pupri P.S. Case No. 14 of 2014 registered for the offences under Section 366(A)/34 of the Indian Penal Code. It is alleged in the written report that on the alleged date of occurrence, the daughter of the informant, namely, Tahseen Khatoon, who is a student of Class-VIII, had gone to the School to bring the School Leaving Certificate, but she did not return till 5.00 P.M. The informant made search of her and learnt from Md. Shageer that her daughter was seen with three accused persons including the petitioners. The informant searched her daughter, but

Patna High Court Cr.Misc. No.45799 of 2014 (3) dt.16-04-2015 2 / 2 she could not get her traced. The informant suspected that all the accused persons have kidnapped the minor daughter of the informant for illegal purpose.

It has been submitted on behalf of the petitioners that the petitioners have falsely been implicated in the present case and there is no specific allegation against the petitioners. On behalf of the State, it has been submitted that a minor girl has been abducted by the accused persons, who later on, is being said to have been recovered from Surat i.e., the State of Gujrat.

Considering the nature of allegations made against the petitioners, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, the same is rejected in connection with Pupri P.S. Case No. 14 of 2014, pending in the court of the learned Chief Judicial Magistrate, Sitamarhi.
