JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-08-2019 This application, for grant of anticipatory bail, arises out of Telhara P.S. Case No. 36/2019, disclosing offences under Sections 419 of the Indian Penal Code and Section 30(a)(d) of Bihar Excise Prohibition Amendment Act, 2016. Prosecution case is that police intercepted a motorcycle and seeing the police party, the rider and the pillion rider of the motorcycle fled away leaving the motorcycle and a bag and from search of the bag 7 litres of country made liquor was recovered and the name of the petitioner was disclosed by the local chowkidar.

Submission of learned counsel for the petitioner is that he has no criminal antecedent and has falsely been implicated in this case and he has nothing to do with the recovered liquor and further the motorcycle also does not

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -III cum Special Judge, Excise, Nalanda at Biharsharif, in connection with Telhara P.S. Case No. 36/2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
